These Terms of Service ("Terms") govern your use of the iOS app "Vorino" (the "App") and all related services, including the content hosted at vorinoapp.de and the backend API.

By downloading and using the App, you agree to these Terms. If you do not agree, please do not use the App.
The App is distributed exclusively via the Apple App Store. Download and installation are governed by Apple's terms. No separate agreement is concluded between you and the provider regarding the base functionality of the App — these Terms only regulate the legal relationship that arises from your use of the App.
All in-app purchases — in particular the Pro subscription — are processed exclusively through Apple's StoreKit system. The contracting party for each purchase is Apple Distribution International Ltd. (or the relevant Apple subsidiary), not the provider directly. Apple's App Store and Apple Media Services Terms and Conditions apply in addition.
The exact feature set of the Pro tier may change over time. Material changes will be communicated in advance (see § 8).
You agree not to misuse the App. The following are prohibited in particular:
Violations may result in immediate blocking of API access for the affected device.
The Pro subscription is offered as a monthly or annual subscription. Current pricing is shown in the App and on the App Store.
When you first subscribe to the annual Pro plan, Apple grants a 14-day free trial. Unless the subscription is cancelled via your Apple ID at least 24 hours before the end of the trial, it will convert into a paid subscription.
The subscription automatically renews for the selected period (monthly or annual) unless cancelled at least 24 hours before the end of the current period. Billing is performed by Apple using your stored payment method.
Cancellation is handled exclusively via your Apple ID settings:
Settings → [Apple ID] → Subscriptions → Vorino Pro → Cancel Subscription
Cancellation through the provider is technically not possible because Apple manages the contract.
Refund requests must be directed to Apple at: https://reportaproblem.apple.com
The App uses AI models (e.g. for image recognition, recipe suggestions). AI suggestions are statistically derived recommendations and may contain errors. In particular:
Use of the AI features is at your own risk.
The provider strives to maintain a smooth operation but does not owe a specific service level. Maintenance, backend disruptions, or third-party outages (Apple, Google) may temporarily restrict availability.
The provider has unlimited liability for intent and gross negligence as well as for damages arising from injury to life, body, or health. For simple negligence the provider is liable only for breach of material contractual obligations (cardinal obligations), and only up to the typical, foreseeable damage. Further liability is excluded to the extent permitted by law.
Liability under the German Product Liability Act remains unaffected.
The provider is not liable for delays or failures in performance resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labour, or materials.
The App, the App design, source code, logo, and backend infrastructure are protected by copyright and are the exclusive property of the provider or its licensors.
You are granted a simple, non-transferable, non-sublicensable, revocable licence to use the App for personal, non-commercial purposes on your own devices.
Pantry items, favourites, weekly plans, and any other data you create within the App remain your property. Because this data is stored locally on your device and never transmitted to the provider, no licence to the provider is required.
Recipe content is sourced from public-domain sources, own creations, or sources under a compatible licence. This content is intended solely for your personal use within the App — commercial re-use is prohibited without permission from the respective rights holder.
The underlying ML models (CLIP, YOLO, etc.) are used in accordance with the licences of their respective creators.
We may amend these Terms for legitimate reasons (e.g. changes in law, new features, changes to third-party terms).
Material changes will be announced 30 days in advance in the App and at vorinoapp.de/terms. If you do not object within this period and continue to use the App, the amended Terms are deemed accepted.
Where a change materially worsens your position, you may terminate the Pro subscription extraordinarily (cancellation is processed via Apple, see § 5.4).
You may stop using the App at any time by uninstalling it. The Pro subscription is cancelled via your Apple ID (see § 5.4).
The provider may suspend or terminate API access for a device in case of material breach of these Terms (in particular Section 4). For Pro subscribers, any pre-paid period will not be refunded by the provider — refund requests go to Apple (see § 5.5).
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected.
If you are a consumer, the statutory place of jurisdiction applies. If you are a merchant, the place of jurisdiction is the seat of the provider (Leipzig).
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.
We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration body.
Should any provision of these Terms be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected. The invalid provision will be replaced by a regulation that comes as close as possible to the economic purpose of the invalid provision.
You may not transfer your rights and obligations under these Terms to third parties without the prior written consent of the provider.
Amendments and supplements to these Terms require at least text form. This also applies to the cancellation of this text-form requirement.
